Terms of Use
Last updated To be confirmed. Version To be confirmed.
Welcome to Trivzip. Trivzip lets people host live quiz shows on video and lets anyone join from a phone or a browser to play along.
These Terms are the agreement between you and To be confirmed (“we”, “us”). By joining a show, making an account or hosting, you agree to them. If you don’t agree, please don’t use Trivzip.
We’ve tried to write this in plain language. The short version: be kind, only share things you have the right to share, hosts are responsible for their shows, and we can remove things that break the rules.
1. Who can use Trivzip
- Players must be at least 13 years old. You can play without an account. We don’t ask for your birthday, but by joining a show you confirm you’re 13 or older.
- Hosts must be at least 18 years old. Hosts appear live on camera in front of people they may not know. When you first host, you’ll be asked to confirm you’re 18 or older and that you agree to these Terms and the Community Guidelines.
- If you’re 13 to 17 (or under the age of adulthood where you live), please make sure a parent or guardian is OK with you using Trivzip.
- You can’t use Trivzip if we’ve banned you before, or if the law where you live doesn’t allow it.
2. Accounts
- You can play as a guest. You need an account to host, to keep your game history, to have a profile and to follow people.
- You can sign in with Apple, Google or a one-time code we email you. Please use the same sign-in method each time: signing in a different way (for example Apple’s “Hide My Email” on your phone and Google on your laptop) can create two separate accounts.
- Keep your sign-in secure. You’re responsible for what happens under your account. Tell us at support@trivzip.com if you think someone else has used it.
- Your @username, display name, profile picture and bio must follow the Community Guidelines. We may ask you to change a username, or change it for you, if it impersonates someone, infringes a trademark or breaks the rules. Usernames that aren’t used may be reclaimed.
- You can delete your account at any time from your account page, in the app or on the website. Section 13 explains what happens when you do.
3. Profiles and following
- Every account has a public profile, at an address like trivzip.com/@dana. It shows your display name, profile picture, short bio, one link you choose, the quizzes you’ve hosted and the quizzes you’ve played.
- Private quizzes are never shown publicly. Your profile may show a count of private quizzes (for example “+4 private quizzes”) but never their titles, hosts, players or content.
- For each public quiz, “Show on my profile” is on by default. You can hide any quiz from your profile at any time.
- Links you add to your profile open in a new page and are marked so search engines don’t treat them as our endorsement (“nofollow”). We may remove a link that points to harmful, illegal or misleading content.
- You can follow hosts and players. Anyone can see who follows whom. You can remove a follower or block someone.
4. Hosting
- Any signed-in adult can host private shows, shared by link or invite. Private shows don’t appear in Find a show.
- Public shows (listed in Find a show and on your profile) are open to any signed-in adult who accepts these Terms. We may hold a public show out of Find a show while we review it, and we may pause or remove a host’s public hosting at our discretion, for example after reports.
- We may set limits on hosting, such as a monthly cap on live minutes per host, a maximum number of players per show or a limit on how many shows you can schedule. We’ll show these limits in the app.
- As a host you’re responsible for your show: what you say and show on camera, your questions and answers, your show title and description, your promo photo or video, and anything you offer as a prize.
- Prizes: if you offer a prize, you’re responsible for delivering it and for following any laws that apply to contests in your area. You can’t charge people to enter a show or to win. Points and “wagers” in Trivzip are only for fun and have no money value.
- Your show’s scoring and timing are run by our server. Our results are final, except where a host corrects a question during the show using the tools we provide.
5. Your content and the permission you give us
“Your content” means anything you add to Trivzip: show titles, questions and answers, promo photos and videos, your live video and audio, your nickname, typed answers, your profile picture, username, bio and link.
- You keep ownership of your content. We don’t claim it.
- You give us permission (a licence) to use it to run Trivzip. Specifically, you give us a worldwide, non-exclusive, royalty-free permission to store, copy, process, resize or convert (for example making a cover image from a video), stream, display and share your content on and through Trivzip, including:
- live, during the show, to the people watching;
- in Find a show, in the waiting room and on the show’s page;
- on your profile and on past-quiz pages, after the show has ended;
- in link previews when someone shares a link to your show or profile;
- to our service providers, only as needed to run the service (see the Privacy page).
- How long this lasts: your content stays on Trivzip after a show ends, so it can appear on your profile and the quiz’s past-quiz page, until you hide it or delete it, or delete your account. When you delete something, we stop showing it within 24 hours. Copies may remain for a limited time in backups (up to 30 days) and where we need to keep them for legal reasons, such as evidence of a rule-breaking report.
- Hiding versus deleting: hiding a quiz from your profile takes it off your profile but keeps it in your own history; deleting a past show removes it from Trivzip.
- Results and other people: when you play, your nickname and score become part of that show’s results. If you delete your account, we remove the link between your account and those results; the nickname stays on them as it was.
- Promoting Trivzip: we won’t use your face, voice, name or promo in our own advertising without asking you first.
- You promise that you own your content or have permission to use it, including any music, video, images, logos or other people who appear in it, and that our use of it as described here won’t break any law or anyone else’s rights.
6. Promos
A host can add a promo photo, or a short video (up to 30 seconds), to a show.
- Promos must follow the Community Guidelines. Only use music, video and images you own or have permission to use. Most popular songs are not yours to use, even for a few seconds.
- We remove location and camera details from promo files before anyone sees them.
- A promo can appear in Find a show, in the waiting room, after the show and on your profile and past-quiz pages, as described in section 5.
- If someone reports a promo, we hide it straight away until we review it. We’ll restore it if it doesn’t break the rules.
- You can replace a show’s promo or take it off. We keep promos, including ones you’ve replaced or taken off, until you delete your account.
7. Live video
- Only the host sends video and sound. Players’ cameras and microphones are never used.
- We don’t record shows. Video is streamed live through our video provider and isn’t stored by us.
- Don’t record, restream or republish someone else’s show without the host’s permission.
- Hosts must not show anyone on camera who hasn’t agreed to appear, and must never show a child in a way that breaks the Community Guidelines.
- Live video can be interrupted (for example by your connection, our provider or usage limits). We’ll do our best to keep shows running but can’t promise every show will work.
8. Rules of conduct
When you use Trivzip you agree to follow the Community Guidelines, which are part of these Terms. In short, you must not:
- post or show anything sexual, anything involving the abuse or sexualisation of children, hate, threats, harassment, graphic violence, or anything that encourages self-harm;
- impersonate anyone, or mislead people about who you are;
- run scams, spam, or charge people to play;
- share content you don’t have the rights to;
- share other people’s private information;
- cheat, use bots or scripts, or try to break, overload, probe or get around the limits or security of Trivzip;
- break any law.
We have zero tolerance for objectionable content and abusive users. Breaking these rules can lead to content being removed and accounts being suspended or banned.
9. Reporting, moderation and removal
- You can report a show, a promo, or a profile from the app or website. You don’t need an account to report. You can also block a host so their shows don’t appear for you.
- We review reports within To be confirmed, and within minutes during a live show when we’re available.
- A report never takes something down automatically, except that a reported promo or profile photo is hidden until we review it.
- We may remove or hide content, end a live show, limit features, or suspend or ban an account if we believe it breaks these Terms or the law, or puts people at risk. We may also remove public hosting access.
- We’ll tell you why. When we remove your content or limit your account, we’ll tell you what was affected and which rule it broke, unless the law or someone’s safety stops us from doing so.
- Appeals: if you think we got it wrong, reply to our notice or write to support@trivzip.com within To be confirmed days. A person will look at it again and tell you the outcome.
- We may report illegal content, including child sexual abuse material, to the authorities, and keep related information as the law requires.
10. Copyright and takedowns
We respect other people’s rights and expect you to as well.
If you believe content on Trivzip infringes your copyright, send a notice to our copyright agent at copyright@trivzip.com. Your notice should include (this is what US law, the DMCA, asks for):
- your physical or electronic signature;
- what work you believe is being infringed;
- where the infringing content is on Trivzip (a link to the show, promo or profile helps);
- your name, address, phone number and email;
- a statement that you believe in good faith the use isn’t authorised by you, your agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you’re the owner or authorised to act for the owner.
If your content was removed and you believe it was a mistake or you had permission, you can send a counter-notice to the same address with: your signature; what was removed and where it was; a statement under penalty of perjury that you believe it was removed by mistake or misidentification; your name, address and phone number; and a statement that you agree to the jurisdiction of the federal court for your address (or, if you’re outside the US, any court where we can be found) and will accept service from the person who sent the notice. We may then restore the content after 10 to 14 business days unless the other person tells us they’ve gone to court.
Repeat infringers: we’ll ban accounts that repeatedly infringe copyright.
11. Our service and changes to it
- Trivzip is offered as it is. It’s a small, independent product and may change, pause or stop. We may add, change or remove features at any time.
- We’ll try to tell you in advance about big changes that affect you.
12. Disclaimers
- To the extent the law allows, we provide Trivzip “as is” and “as available”, without warranties of any kind, whether express or implied, including that it will be uninterrupted, error-free, secure, or fit for a particular purpose.
- We don’t check every show before it happens. Hosts and players are responsible for what they say and post. Views expressed in shows are the host’s, not ours.
- Quiz questions and answers are written by hosts. We don’t guarantee they’re accurate.
- Some places don’t allow some of these disclaimers, so they may not all apply to you.
13. Ending your use, and deleting your account
- You can stop using Trivzip and delete your account at any time.
- When you delete your account we delete your account details, sign-ins, profile, follows, game history, hosted shows’ public pages, and promo photos and videos, and we cancel any upcoming shows you scheduled (people who said “I’m in” are told it’s cancelled). If you signed in with Apple, we also tell Apple to disconnect Trivzip from your Apple ID; if we can’t, we tell you how to do it yourself. See the Privacy page for what we keep and for how long.
- We may suspend or end your access if you break these Terms, if we have to by law, or if we stop offering Trivzip.
- Sections 5 (for content already shared during a live show), 10, 12, 14, 16 and 17 continue after your use ends.
14. Limits on our liability
- To the extent the law allows, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or opportunities, arising from your use of Trivzip or from anyone’s content or behaviour on it.
- To the extent the law allows, our total liability to you for any claim about Trivzip is limited to the greater of US $50 or the amount you’ve paid us in the 12 months before the claim (Trivzip is currently free).
- Nothing in these Terms limits liability that the law doesn’t allow us to limit.
15. Your responsibility to us
If you break these Terms or the law, or your content infringes someone’s rights, and that leads to a claim against us, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.
16. Changes to these Terms
We may update these Terms. If a change is important, we’ll tell you in the app or by email at least To be confirmed days before it takes effect, and hosts will be asked to accept the new version. If you keep using Trivzip after a change takes effect, you accept the updated Terms. The date and version at the top always show the latest.
17. Governing law and disputes
These Terms are governed by the laws of To be confirmed, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in To be confirmed, unless the law where you live gives you the right to use your local courts. Before going to court, please write to us at support@trivzip.com so we can try to sort it out informally.
18. Apple
If you use Trivzip on an iPhone or iPad: these Terms are between you and us, not Apple. Apple isn’t responsible for Trivzip or its content, has no obligation to provide support for it, and isn’t responsible for any claims about it (including product liability, legal compliance or intellectual-property claims). If Trivzip doesn’t meet a warranty that applies, you can tell Apple, and Apple may refund the price you paid (Trivzip is free, so that’s $0). Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you. You confirm you’re not in a country under a US government embargo and not on a US list of prohibited or restricted parties.
19. Other terms
- These Terms, the Community Guidelines and the Privacy page are the whole agreement between you and us about Trivzip.
- If part of these Terms can’t be enforced, the rest still applies.
- If we don’t enforce a part of these Terms right away, we can still enforce it later.
- You can’t transfer your rights under these Terms. We may transfer ours, for example to a company we form to run Trivzip; we’ll tell you if we do.
